❖ Recitals
• Jibe Mobile, Inc., organized in the state of Delaware, USA, (“Jibe”) is the developer and
owner of RCS (Rich Communications Services) Business Messaging, an API-based
platform and associated software that enables businesses/Brands to reach their
customers(End Users) with rich conversations via the users’ default carrier messaging
apps.
• NXC Controls have been duly authorized by operators (VI, JIO, BSNL, Airtel) & Jibe to
provide RBM as a service.
Disclaimer:
• NXC CONTROLS represents that RBM is a third-party product owned and developed by
Jibe and its associates and NXC CONTROLS is not in any manner responsible or liable for
such services or deficiency thereof.
• NXC CONTROLS does not warrant or represent that RBM will operate in a manner that is
uninterrupted or error-free. NXC CONTROLS is not responsible or liable in any manner
whatsoever for the content of messages that Brand or any other End User sends using
RBM.
• TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NXC CONTROLS MAKES NO
CONDITIONS, REPRESENTATIONS, WARRANTIES, OR OTHER COMMITMENTS (WHETHER
EXPRESS OR IMPLIED, INCLUDING AS TO SATISFACTORY QUALITY, FITNESS FOR A
PARTICULAR PURPOSE OR CONFORMANCE WITH A DESCRIPTION) REGARDING RBM.
Commercial Terms
• All Charges shall be payable from the Service Commencement Date.
• The amount paid for the service is not refundable.
• Also, we (NXC Controls Pvt. Ltd.) are not responsible if the service is paused by
Google. In that case, the Client (Brand) won’t get a refund But the remaining
credits can be used for our other services.
